Abdullah ÖCALAN, şu bu pazarlığına ve sapık hallusinasyonlara kapılmadan yargılanmalı; daha doğrusu, yargısal bir namusluluk denemesi gerçekleştirilip bu insan özgür bırakılmalı! - Avrupa Yargılıkları ne diyor? - Avrupa İnsan Hakları Mahkemesi'nin (AİHM), 12 Mayıs'ta açıklayacağı ve Abdullah Öcalan'a 'yeniden yargılama' yolunu açabilecek son kararını bekleyen Dışişleri Bakanlığı, bundan sonraki süreç ve olası gelişmeler hakkında hükümeti bilgilendirdi. Dışişleri, Strasbourg kaynaklarından, mahkemenin temyiz organı olarak görev yapan 17 yargıçlı Büyük Daire tarafından açıklanacak kararın, 2003 tarihli ilk karar gibi olacağı ve Türkiye'den 'adil yargılama hakkı' ilkesine uyumun isteneceği bilgisine ulaşmıştı. Bunun üzerine, Türkiye ve Avrupa'da yaşanacak gelişmeler de dikkate alınarak hükümete, 'Yeniden yargılama konusunda kanun değişikliği şart' telkininde bulunuldu. Dışişleri Bakanlığı'na göre, 12 Mayıs sonrası süreç ve bu süreçte Türkiye'nin yapması gerekenler ve Avrupa'da yaşanacak olası gelişmeler şöyle: AİHM Büyük Dairesi'nin 12 Mayıs'ta açıklanacak Öcalan kararı AİHM sistemi içinde nihai karardır. Kararda, Türkiye'den 'adil yargılama hakkı'na uyum istenmesi kuvvetle muhtemeldir. Bundan sonra uygulamaya geçilecektir. Karar, uygulanmasının izlenmesi amacıyla, Delegeler Komitesi'ne havale edilecektir. Konunun, komitenin haziran toplantısında gündeme alınması beklenebilir. Kararda hükmedilmesi beklenen yargılama giderlerinin (100 bin avro) ödenmesi üç ay içinde yapılmalıdır (12 Ağustos'a kadar). Haziran toplantısında kararın uygulanması, gündemde olmakla birlikte, ele alınmayabilir. Konu komitenin temmuz toplantısında görüşülmeye başlanabilir. Toplantıda, Türkiye'nin kararın uygulanmasına ilişkin almayı öngördüğü önlemler sorulabilir. Komitenin ekim toplantısında, ödeme yapılmış olacağından, bu kez yeniden yargılanma konusundaki önlemler sorulabilir. İzleyen dönemde, konunun iki-üç ayda bir Delegeler Komitesi toplantısı gündemine alınması beklenebilir. Öcalan ve onunla aynı durumda olan diğer başvurulara ilişkin kararların uygulanmasına yönelik olarak gittikçe artan baskı uygulanacağı tahmin edilebilir. Dönem başkanınca hükümetimize mektuplar yazılabilir, ara kararlar alınabilir. Baskı, Öcalan'la 90 kişiye yeniden yargılanma başvurusunda bulunmayı sınırlayan kanun maddesi değiştirilinceye kadar devam edecektir. - AB üyeliği yolunda 'tehdit' mi? - Tehdit, zeka düzeyi düşük sürülerin ve uyutulmuş zavallıların kafalarının içindeki, "kendinden menkul" bir illettir... Kimsenin derdi yok, "Amman, çeteler Cumhuriyeti Avrupa Birliği'ne girmiş girmemiş".... - Anladığım, siyasi boyutta Avrupa'da çeşitli çevrelerin (Avrupa Konseyi Parlamenterler Meclisi, Avrupa Parlamentosu, AB Komisyonu, AB ülkeleri, sivil toplum kuruluşları...) Türkiye'nin AİHM kararını uygulaması yönünde gelişen baskı uygulamaları, AB üyelik süreci bağlamında tehditler beklenmelidir. AİHM, 2003 yılı Mart ayında aldığı kararda, Öcalan'ın avukatlarının başvurusuyla ilgili olarak, Türkiye'nin Avrupa İnsan Hakları Sözleşmesi'nin (AİHS) adil yargılanma hakkıyla ilgili 6., gözaltı süresinin uzunluğuyla ilgili 5. ve kötü muameleyle ilgili 3. maddesini ihlal ettiğine hükmetmişti. Türkiye'nin AİHS'nin adil yargılanma hakkıyla ilgili 6. maddesinin 1. ve 3. fıkralarını ihlal ettiğini savunan AİHM, duruşmalar başladıktan sonra askeri yargıcın sivil yargıçla değiştirilmesini yeterli görmemiş ve savunma için gerekli olanak ve zamanın verilmediği-ne karar vermişti. Mahkeme, AİHS'nin gözaltı süresiyle ilgili 5. maddesinin 3. ve 4. fıkralarının da ihlal edildiğini, Öcalan'ın mahkemeye çıkarılmadan önceki gözaltı süresinin de uzun olduğunu savunmuştu. AİHS'nin yaşam hakkıyla ilgili 2. maddesiyle ilgili şikâyet konusunda, Türkiye'nin ihlalde bulunmadığı görüşüne varan AİHM, Öcalan'ın adil olmayan bir yargılama sonucunda ölüm cezasına çarptırılmasını, AİHS'nin kötü muamelenin önlenmesiyle ilgili üçüncü maddesinin ihlali olarak görmüştü. AİHM, Öcalan'ın Kenya'dan yasadışı şekilde getirildiği ve ayrımcılığa tabi tutulduğu yolundaki şikâyetleri ise reddetmişti. Mahkeme, saptadığı ihlallerin şikâyetçinin olası mağduriyetini gidermeye yeterli olduğu gerekçesiyle Türkiye'yi maddi ve manevi tazminata mahkûm etmemişti.
